In 2012 there were 2,644 reported data breaches within the United States. One report found that 86 percent of internet users have taken measures to minimize their digital footprint. As data protection and consumer privacy become a growing public concern, State Attorney General Offices have increasingly stepped-in to protect the privacy and personal information of internet users. Given the increase in civil enforcement, this presentation will discuss the legal framework that State enforcers use to prosecute and investigate data protection and consumer privacy matters. In particular, what is the jurisdictional basis for State enforcement? What are the legal and statutory tools available to State law enforcement? What are the legal remedies? What issues have State Attorneys General delved into and where should they go next?

Bio:

Jah-Juin “Jared” Ho, Esq. is currently a Deputy Attorney General at the New Jersey Office of the Attorney General. As a Deputy, Jared has investigated, prosecuted, and settled matters involving bitcoins, botnets, cookie tracking, and mobile apps. Commencing December 2013, Jared will start his new position as Staff Attorney in the Mobile Technology Unit of the Federal Trade Commission.
